When Doña Marta wanted to formalize the group with which she delivered food to homeless families in Itagüí, she was stopped by a single phrase she kept hearing in the neighborhood: "Creating a foundation costs millions." She resigned herself to working for two years without a legal structure, unable to receive donations or apply for grants. The day she finally sat down to really look into it, the calculations showed it cost far less than she had feared: the basic paperwork cost less than a large grocery shop.
In short: How much does it cost to create a foundation in Colombia? It depends on three things: the Chamber of Commerce registration fees (starting at around 1,434,000 pesos), the registration tax (0.7% of initial assets, depending on the address), and whether or not you hire a lawyer. Many small foundations complete the entire registration process with a budget of between 1,430,000 and 1,448,000 pesos, excluding legal fees. Here's a breakdown of each cost so you can create your actual budget.
What are the mandatory costs for creating a foundation?
A foundation is a non-profit entity (NPO) which allocates assets to a cause of general interest. For it to exist legally, it must be registered, and this registration has fixed fees that you cannot avoid, but they are modest.
- Registration fees for the articles of incorporation: The Chamber of Commerce collects them. Public registry fees are set annually by the National Government by decree, so they increase slightly every January. In practice, they start at around $34,000.
- Registration tax: This is equivalent to 0.7% of the initial capital you contribute to the foundation. It is paid to the Departmental Government (in some cities, it is collected by the Chamber of Commerce itself). If your initial capital is small, this tax will also be small.
- RUES form and registration: The registration form is usually included or has a low cost within the same procedure at the Chamber.
Beware of a common confusion: the initial equity It's not a "fee" that gets lost. It's money (or assets) that remains within the foundation to fulfill its purpose; it still belongs to the project, not an expense of the process.

That's why, when someone tells you that "registering with the DIAN is expensive," be suspicious: they are probably charging you for a management service, not for the procedure itself.
How much does a lawyer cost, and is it mandatory?
The lawyer It is not mandatory. The law does not require professional assistance to establish a non-profit organization: you can draft the articles of incorporation and bylaws yourself and submit them to the Chamber. If your case is simple—a local foundation with few founders and a clear purpose—it is perfectly possible to do so without a lawyer.
When is it worthwhile to pay it? When there are international donors, high net worth, or complex governance that needs to be carefully designed in the bylaws. In these cases, fees typically start at 1,500,000 and increase according to the complexity. Common mistakes when calculating the cost
- Hiring a lawyer "because it's necessary". It's not mandatory; if your case is simple, that's the biggest expense you can save.
- Confusing creating with maintaining. The incorporation cost is a one-time fee; separately there are the annual obligations (renewing the registration in the Chamber and updating the RTE each year).
- Forget the registration tax. The 0.7 % depends on the initial assets and the department; budget it from the beginning to avoid surprises.
How much does it cost to maintain the foundation each year?
Creating the foundation is a one-time payment, but maintaining it has recurring costs that should be clearly understood.
